An attorney must scrutinize the process and procedure of the officer(s) in conducting the (1) the stop, (2) the field tests, and (3) the breath test in Virginia DUI | DWI cases. In cases of Reckless Driving, the attorney must scrutinize (1) the stop, (2) the observations of the police, and (3) the overall evidence that you were driving "recklessly."  In reckless driving cases based on speed alone, the attorney must analyze the calibrations of the officer's radar |lidar and/or vehicle speedometer (pace cases). If there is a flaw in procedure or in radar maintenance, it is the defendant's resposibility to move the court to strike the evidence.

Because flaws in calibrations and maintenance records of police equipment are not per se exculpatory, most government agents will not disclose faulty calibrations or faulty maintenance of speed assessment units unless directed to by the Judge.  Lawyers experienced in traffic law assess these issues in posturing the defense.  Lawyers with former police officers on their team certainly have an insight in this arena.

Tip: Always demand to see calibration records in speed cases.  Speed assessment devices must be calibrated within 6 months of your charge/offense date.  Make certain that the calibrations are notarized properly.

A lawyer is responsible for advancing technical arguments and should analyze your case for procedural flaws.  Procedural flaws may be leveraged to force the prosecution to dismiss the case.  Preparation and knowledge are the keys to success.  The police need articulable and reasonable suspicion to stop a vehicle and they need probable cause to arrest a defendant for a crime.  Lawyers must review the facts of your case and assess whether to challenge the stop and/or arrest. 

Your attorney should know the recent rulings and sentencing trends of judges in your court.  She should be familiar with the possible sentences and be able to advise you on possible outcomes prior to the court date. She should know when to ask for a continuance and when to plea bargain with the prosecution.

Tip: You have 10 calendar days to appeal your case to the Circuit Court upon conviction in the General District Court.  You also can appeal immediately upon conviction by making a motion immediately to the Judge in the General District Court.  When you appeal a case, the appeal stops the suspension of license and stays all jail time imposed by the General District Court Judge.

Experienced attorneys in the northern Virginia region charge between $2500 and $9000 for representation in a DUI case and between $1050 and $2500 in reckless driving cases. Representation in a Driving on a Suspended License usually warrants the same fee as Reckless Driving, unless there are egregious facts and/or underlying convictions for which the license was originally suspended.
